In the case of false statements, the competitor and rider release the group of persons specified in the machine owner’s disclaimer from all claims for damages in connection with the event (including untimed and timed practice, qualifying practice, warm-up, tests and reconnaissance/inspection laps, races, heats, and special stages aimed at achieving maximum speeds or shortest driving times). This also applies to costs incurred by the machine owner in reasonably asserting their legal rights.
General contractual statements of competitors and riders (competitor and rider = participant):
The participants are jointly and severally liable for all obligations arising from the entry contract. The participants confirm that the information provided on this entry form is correct and complete, that they are fit to meet the requirements of the event (including untimed and timed practice, qualifying practice, warm-up, tests, and reconnaissance sessions, races, heats, and special stages aimed at achieving the highest possible speeds or shortest driving times) without restrictions, and that the machine complies in all respects with the current applicable Technical Regulations. The scrutineers may inspect any part of the machine at any time. The machine will be made available to the scrutineers for any technical checks requested by the stewards at no cost, and it will always be presented at each event in perfect technical and visual condition.
By signing, I furthermore confirm that I have taken note of the FIM (Fédération Internationale de Motocyclisme) and FIM-Europe International Sporting Code, the Auto-Cycle Union Ltd. (ACU) and ACU Anti-Doping Regulations, relevant KNMV Regulations, the KNMV Environmental Code, and other FIM, FIM-Europe, ACU, and KNMV regulations, and that I will accept and comply with them.
By signing this document, I also accept that:
Circumstances relating to the person or behavior of any team member (competitor, rider, mechanic, staff member, etc.) affecting the contractual relationship with the organiser or giving rise to a claim for damages shall be applicable to and enforceable against them. The ACU/KNMV, its jurisdiction, the stewards, and the organisers – each within the scope of their responsibilities – are authorised, in addition to other procedures, to impose penalties for infringements of sporting regulations, legal sporting provisions, and contractual obligations, as provided in the International Sporting Codes of the FIM/FIM-Europe, Supplementary Regulations, and other provisions, irrespective of the right to pursue legal action under the International Sporting Codes. All competitors are prohibited from using any substances or methods listed in the WADA World Anti-Doping Code and in the FIM/FIM-Europe Anti-Doping Regulations.
Protest and appeal proxy
By submitting the entry form, the participants authorise each other to represent the other party/parties in any protest or appeal. This authorisation includes, in particular, the power to submit protests, withdraw protests, notify of the intention to appeal, submit appeals, confirm or withdraw appeals, declare that they will not appeal, and to submit and receive all statements or applications related to a protest or appeal.
Declaration by participants on exclusion of liability:
Participants take part in the event at their own risk. They bear sole responsibility under Dutch civil and criminal law for any damage caused by them. They waive any claims or rights to seek damages in connection with the event against:
- Their own participants (except where special agreements exist) and assistants.
- Other participants, owners, or registered keepers of all machines participating in the event (if on a closed track) and their assistants.
- The FIM, FIM-Europe, ACU, KNMV, KNMV-affiliated and member organisations, their presidents, executive bodies, managing directors, secretaries general, and staff.
- LDP International BV, Next Level Support Assen BV, their presidents, executive bodies, managing directors, secretaries general, staff, and members.
- The promoter/series organiser, the organiser, officials and marshals, circuit owners, authorities, racing services, and all other persons involved in organising the event.
- The organisation responsible for road construction and maintenance, and all agents, employees, legal representatives, full-time staff, and volunteers of the above-mentioned persons and entities.
The disclaimer does not apply to damages or harm to life, body, or health, or to any other damage resulting from intentional or grossly negligent breaches of duty, nor to damage resulting from a material contractual obligation violated by the released parties. In the case of damage resulting from slightly negligent breaches of material contractual obligations, liability for financial loss and property damage is limited to the typical foreseeable damage. The disclaimer applies to claims of any legal nature, including contractual and non-contractual liability and claims arising from tort.
Implied exclusions from liability remain unaffected by the above. By submitting the entry form, participants understand that no coverage exists under motor traffic insurance (vehicle liability, physical damage insurance, vehicle occupant accident insurance) for damages incurred during events aimed at achieving maximum speeds. Participants undertake to inform the owner or registered keeper of the machine used.
If an injury occurs, is detected during the event, or any health issue arises that could temporarily or permanently affect fitness to participate in motorcycle sport events, the undersigned releases all treating doctors from confidentiality obligations among themselves and with regard to the clerk of the course, stewards, judges, chief medical officer, other doctors, and insurance claims administrators. I consent to the storage, transmission, and management of my personal data in accordance with the KNMV Data Protection Provisions and the Dutch Data Protection Act.
